In Instron Ltd v Denny (7.6.89) EOR27C, the EAT holds that where a tribunal has found that the real reason for an employee's dismissal is misconduct, the dismissal could not be on racial grounds. This suggests that the EAT misunderstands fundamental principles of discrimination law.
