Kenny v Hampshire Constabulary [1999] IRLR 76 EAT

Reports relating to this case:

  • Limits of a reasonable adjustment

    1 March 1999

In Kenny v Hampshire Constabulary (14 October 19998) EOR84D, the EAT rules that an employer's duty under the Disability Discrimination Act 1995 to make a reasonable adjustment to arrangements on which employment is offered or afforded is restricted to "job related" matters.

  • Disability discrimination: No duty on employers to provide carers to attend to employees' personal needs

    1 February 1999

An employer's statutory duty under the Disability Discrimination Act to make "reasonable adjustments" did not extend to providing a carer to assist a disabled person when using the toilet, notwithstanding that without that help the disabled person was deprived of the opportunity to be employed by the employer, holds the EAT in Kenny v Hampshire Constabulary.
