    In Kwik Save Stores Ltd v Greaves (18 December 1996) EOR74D, the EAT holds that in order for the right to return to work after maternity leave to be exercised, a woman must physically return to work on the notified day.

  • Handing in sick note is not return to work

    A woman who gave a valid notice of her intention to return to work and then handed in a medical certificate on her notified day of return stating that she was unfit did not "return to work", in accordance with the statutory maternity leave requirements, the EAT has ruled in Kwik Save Stores Ltd v Greaves.
