In Mason v Governing Body of Ward End Primary School  IRLR 432 EAT, the Employment Appeal Tribunal holds that the "no difference" rule in s.98A(2) of the Employment Rights Act 1996 applies only where the employer has failed to follow "a procedure" in existence at the time of the dismissal, and not to other failings not set out in a specific procedure.
