In Newland v Simons and Willer (Hairdressers) Ltd [1981] IRLR 359 EAT, the EAT held that where a contract of employment is being performed illegally by the employer, whether the employee is in turn affected by that illegal performance depends upon whether he was a party to or knew of his employer's illegality.
