In Ratcliffe and others v North Yorkshire County Council (7 July 1995) EOR63C, the "dinner ladies" case, the House of Lords holds that the alleged need to reduce the wages of a female-dominated job in order to compete with outside contractors was not a material factor defence free of sex discrimination so as to fall within s.1(3) of the Equal Pay Act.

In Ratcliffe and others v North Yorkshire County Council the House of Lords upholds a finding that women school catering assistants were entitled to receive the same rate of pay as their male comparators employed by the council on work rated as equivalent.
