In Safeway Stores Ltd and others v Twigger and others  EWCA Civ 1472 CA, the Court of Appeal struck out a supermarket's claim to recover the costs of a penalty for breach of the Competition Act 1998 from the directors and employees responsible for the infringement.
The Court of Appeal has confirmed that a company that is found to be in breach of competition legislation may not pass on the liability of any penalty imposed to its employees.
