In Sanchez Hidalgo and others v Asociacion de Servicios Aser and Sociedad Cooperativa Minerva  IRLR 136 ECJ, the European Court of Justice held that the Acquired Rights Directive applied to a situation in which a public body contracted out its home help services to people in need or awarded a contract for the surveillance of some of its premises and on expiry of the contract the public body contracted out the service to a different undertaking, provided that the operation is accompanied by the transfer of an economic entity between the two undertakings.
