The EAT holds in Secretary of State for Education and Employment v Bearman and others that, in the absence of any evidence that the initial contractual position had changed, disabled persons who, under the Sheltered Protection Scheme, entered into a contract of service with a "sponsor" organisation which then hired out their services to a "host" organisation did not thereby become employees of the host organisation.
