A reorganisation exercise, which involved inviting existing employees to apply for a smaller number of newly-created posts, was no more than "window-dressing" for an ordinary redundancy situation. This industrial tribunal decision is upheld by the EAT in Sheerness Steel Co plc v Jones, as is the tribunal's conclusion that an employee who was not selected for one of the new jobs was unfairly selected for redundancy.
