In Sheffield v Oxford Controls Company Ltd  IRLR 133 EAT, the EAT held that the Industrial Tribunal was entitled to find that the appellant employee had not been dismissed in law when he agreed to terminate his employment upon terms which were satisfactory to him, notwithstanding that he had been threatened with dismissal if he did not resign.
