In Smith v Edmundson Electrical Ltd EATS/0017/06 the Employment Appeal Tribunal held that where an employee claimed a three-month extension of time for issuing tribunal proceedings on the ground that he had submitted a statement of grievance during the limitation period, having rejected that contention, the tribunal was under no obligation to consider, in the alternative, whether or not the employee had a reasonable belief that a dismissal procedure was ongoing.
