The Court of Appeal in Stapp v The Shaftesbury Society confirms a number of the guidance points identified in our previous article, and adds that where notice of dismissal is superseded by summary dismissal, the effective date of termination is the date on which the summary dismissal is communicated to the employee, even if the summary dismissal is wrong in law.
