An employment tribunal has held that it does have jurisdiction to hear a claim under the Disability Discrimination Act 1995 on the ground of an association with a disabled person.
The ruling, made at a pre-hearing review, follows a reference by the employment tribunal to the European Court of Justice (ECJ) when Ms Coleman brought a claim that she had been discriminated against because she is the primary carer for her disabled son.
