Two recent industrial tribunal decisions, Boyce and others v British Airways plc 1 and Power v Northern Joint Police Board 2, arrive at contrasting conclusions as to whether the Scots and the English constitute different "racial groups" for the purpose of the Race Relations Act 1976.

"Racial group" is defined in the Act as meaning "a group of persons defined by reference to colour, race, nationality or ethnic or national origins."

In the Power case, an Edinburgh industrial tribunal (Chair: S F R Patrick) held that it had jurisdiction to entertain the applicant's complaint that the employer discriminated against him on grounds of his English national origins by not shortlisting him for the post of Chief Constable of the Northern Constabulary.
