In Barclays Bank plc v Kapur and others (29.6.89) EOR27A, the Court of Appeal holds that where a discriminatory rule or practice is maintained by an employer, the act of discrimination continues so long as it is maintained. This leads the Court of Appeal to overrule the EAT and hold that the bank's refusal in the early 1970s to credit the complainant's past service with banks in Africa as pensionable service could be challenged as a continuing act of discrimination.
