In Flack and others v Kodak Ltd 22.5.86 Court of Appeal the Court of Appeal upholds the EAT's decision that when determining whether a gap in employment is due to a temporary cessation of work, thus preserving continuity of employment, a tribunal must look at all the circumstances of the case In the context of the whole period of employment, rather than adopt a strict mathematical approach.
