In Hutchings v London Borough of Islington [1998] ICR 1230, the Court of Appeal holds that a county court had jurisdiction to consider a retired council caretaker's complaint that he had suffered underpayment of his pension. The claim centred on the issue of whether, under his contract of employment, the rent rebate to which the caretaker was entitled during his employment constituted part of his pensionable remuneration.
