Contracts of employment: Suspension of practising certificate does not terminate staff contract
This report relates to 1 case(s)
Rose v Dodd IRLR 977 CA (0 other reports)
In Rose v Dodd EWCA (Civ) 957, the Court of Appeal holds:
- Intervention by the Law Society in a sole practitioner solicitor's practice, and the suspension of the solicitor's practising certificate, did not automatically terminate an employee's contract of employment.
- In this case the parties to the contract were happy for that contract to continue in respect of work connected with the solicitor's challenge to the intervention, which did not involve the conduct of a solicitor's practice.
