In Davies v McCartneys (23 May 1989) EOR28D, the EAT holds that there is no limitation on the factors which may be regarded as "material" under s.1(3) of the Equal Pay Act 1970. Accordingly, an industrial tribunal was entitled to find that the employers had established a defence under s.1(3) by showing that the applicant's job was less demanding and responsible than that of her male comparator.
