The difficult issue of disability-related discrimination is considered in O'Hanlon v The Commissioners for HM Revenue & Customs (30 August 2006). The EAT holds that a reduction in pay, in accordance with the employer's sick pay rules, as a result of absences related to an employee's disability, is disability-related discrimination. The EAT also upholds the tribunal's decision that the discrimination was justified.
