In accordance with the Marshall decision, state employees can challenge discriminatory retirement ages under European law. The scope of employment by the state for these purposes, however, is by no means clear. So far, industrial tribunals have held that employees of Rolls-Royce plc are state employees, but those employed by the University of Glasgow and by British Gas are not state employees.
