In Pugh v The National Assembly for Wales EAT/0251/06, the Employment Appeal Tribunal held that, as long as it indicates an ongoing situation where disabled employees were treated less favourably than others, a continuing act of discrimination does not have to show a discriminatory policy, regime or practice.
