Only the Commission for Racial Equality can bring proceedings in respect of a job advertisement which indicates that the advertiser intends to do an unlawful act of race discrimination, holds the EAT in Cardiff Women's Aid v Hartup. An industrial tribunal was wrong to hold that an advertisement constituted part of the arrangements for determining who should be offered employment, thus giving it jurisdiction to hear a race discrimination complaint from someone who had not applied for the job advertised.
