Victimisation of a person because he or she has "done anything under or by reference to" the Race Relations Act 1976 is unlawful in certain circumstances (s.2). Past case law has made It difficult for complainants to establish such victimisation because tribunals have compared the treatment of a person who has done an act protected by s.2 to that of a person who has done a similar but unprotected act.
