An employee who accepted an early retirement package when his post ceased to exist after reorganisation was dismissed, and was entitled to a redundancy payment. This industrial tribunal decision is upheld by the EAT in Renfrew District Council v Lornie. The employee had not voluntarily terminated his employment. The termination had been at the instigation of the employer, even though the employee had acquiesced in the option of taking retirement rather than continuing in employment with the prospect of some other post eventually being "conjured up" for him.
