In Reid v North West Ceilings Ltd t/a Shopspec 2.4.01 EAT , the EAT holds that a shopfitter/joiner, with supervisory responsibilities, fell into the now well-recognised category of employees on the "lump", despite the fact that both he and his employer had treated him as self-employed for tax and NI purposes. An employment tribunal had erred in its approach to the issue of his employment status when it failed to show that it had evaluated the facts of the case in accordance with any of the relevant legal tests, an application of any of which would have led to the inevitable conclusion that he was an employee.
