Equal Pay: Age limit for unfair dismissal and redundancy pay contrary to EC law

The upper age limit on employees claiming unfair dismissal and statutory redundancy pay is contrary to Article 119 of the Treaty of Rome because it indirectly discriminates against men and is not objectively justified, holds a London South industrial tribunal in Nash v Mash/Roe Group Ltd 5.2.98 case no.2302446/97. Accordingly, the tribunal holds that a man who was dismissed by his employer at the age of 69 is entitled to pursue claims for unfair dismissal and redundancy pay.
