Equal pay: Separate collective bargaining defence rejected

In British Road Services v Loughran [1997] IRLR 92, the Northern Ireland Court of Appeal considers the circumstances in which separate pay structures based on different collective bargaining arrangements can constitute a "genuine material factor" defence to an equal pay claim. By a majority, the Court holds that the mere existence of separate bargaining arrangements does not provide a defence if the applicants are members of a group of which a "significant" number are female.
