A woman who gave a valid notice of her intention to return to work and then handed in a medical certificate on her notified day of return stating that she was unfit did not "return to work", in accordance with the statutory maternity leave requirements, the EAT has ruled in Kwik Save Stores Ltd v Greaves.
Mrs Greaves took extended maternity leave on 8 April 1994, having given the requisite notice then required to her employer.
