The fact that an applicant may have a negligence claim against a solicitor in respect of an out-of-time discrimination complaint does not necessarily mean that it is not "just and equitable" for the complaint to be heard, the EAT has held in Ministry of Defence v Cowan.

Paul Cowan was a soldier serving in Germany. He alleged that on 8 December 1996, after a night out, he awoke to find himself being sexually assaulted by a serving NCO.
