The facts

Mr Mears was employed as a security guard by the respondents. The terms of employment which he was given in accordance with s.1 of the Employment Protection (Consolidation) Act made no mention of whether he was to be paid during periods of absence through sickness. He applied to an Industrial Tribunal for a declaration under s.4 of the Act of what particulars ought to have been included in his written statement.
