An employment tribunal applying the Secretary of State's Guidance on the definition of disability should not balance out the effect of an impairment on different activities, according to the EAT in Leonard v Southern Derbyshire Chamber of Commerce.

Jill Leonard was dismissed from her post as a claims management advisor after having been off work with clinical depression. She claimed that she had been unlawfully discriminated against on grounds of disability.
