In Lawson and others v Britfish Ltd (29.4.87) EOR14F, the EAT rules that the reference in the definition of "the same employment" in s.1(6) of the Equal Pay Act 1970 to common terms and conditions relates only to cases where the applicant and her comparator are employed at different establishments. Where the applicant and her comparator are employed at the same establishment, there is no requirement that common terms and conditions be observed.
