In Quinn v Schwarzkopf Ltd the EAT has held that an employer cannot justify disability discrimination where, in fact, it did not apply its mind during the currency of the employment to what should be done because it was ignorant of the disability.
Mr Quinn was employed as a sales representative. He became ill in the early 1990s and went on sick leave.
