    In Allonby v Accrington & Rossendale College and others [2004] IRLR 224 ECJ, the European Court of Justice held that a female lecturer employed via an agency could not claim equal pay in relation to a male lecturer employed directly by the college. The employment agency and the college could not be construed as being the same employer, and the differences in equal pay could not be attributed to a single source, so there was no single body responsible for the inequality.

    In Allonby v Accrington & Rossendale College and others, the European Court of Justice (ECJ) rules that a lecturer employed through an agency could not claim equal pay with lecturers employed directly by the college, but she could claim entitlement to join the lecturers' statutory pension scheme even though it was open only to those with a contract of employment.

  • Security firm could not buy out workers' statutory minimum holiday entitlement

    In this case, a security company told workers that their 28-day entitlement to annual leave would be reduced because they were paid double for working bank or public holidays. The Northern Ireland industrial tribunal found this to be a breach of the workers' statutory right to a minimum of 28 days' annual leave.

    In Annabel's (Berkeley Square) Ltd and others v Commissioners for Her Majesty's Revenue and Customs [2009] EWCA Civ 361 CA, the Court of Appeal held that, where restaurant or bar tips are paid to staff through a third-party "troncmaster" (from the troncmaster's bank account), the money received by the staff in this way is not "paid by the employer" for the purposes of the National Minimum Wage Act 1998. The employment tribunal had therefore erred when it decided that three employers could count money distributed by a troncmaster towards their obligation to pay the minimum wage.
