Race discrimination: Failure to prevent or minimise racial harassment was discriminatory

In Bennett v Essex County Council and others 5.10.99 EAT 1447/98, the EAT holds that the relevant authorities failed to take all reasonable steps to prevent a black schoolteacher being subjected to racial harassment by pupils. Moreover, she had shown that the harassment was something that was sufficiently under the authorities' control that they could have prevented it or reduced its extent by the application of good education practice.
