An employment tribunal had no jurisdiction to consider a complaint that the decision not to reinstate an unfairly dismissed employee had been caused by continuing race discrimination and victimisation, holds the Court of Appeal in D'Souza v London Borough of Lambeth 25.5.01 Court of Appeal. The Court was bound by its decision in Post Office v Adekeye (No.2) [1997] IRLR 105, and the tribunal had been right to conclude that that was fatal to the complainant's case.
