A representative taken on by an investment services company to sell its insurance and pensions to the public, with remuneration on a commission-only basis, was in the company's employment for the purposes of the Race Relations Act 1976, holds the EAT in Hill Samuel Investment Services Group Ltd v Nwauzu. The EAT also upholds a tribunal's finding that the company discriminated against the sales representative, who was Nigerian by birth, when it allowed the issue of his race to influence its decision to terminate his contract.
