The concept of victimisation under the Race Relations Act requires the discriminator to have a motive which is consciously connected with that legislation, confirms the Court of Appeal in Nagarajan v London Regional Transport [1998] IRLR 73. If the necessary causal link is to be established, it must thus be shown that the fact that a "protected act" was done (or believed to have been done) by the complainant under or by reference to the RRA at the very least "influenced" the alleged discriminator in its unfavourable treatment of the complainant.
