Race discrimination: 'Without prejudice' privilege waived

In Brunel University and another v Vaseghi and another [2007] IRLR 592 the Court of Appeal held that both the employee and the employer had waived the "without prejudice" principle when they referred to earlier privileged discussions at a grievance hearing, and in their pleadings before the employment tribunal.
