Dentmaster (UK) Ltd v Kent [1997] IRLR 636 CA (0 other reports)

In Dentmaster (UK) Ltd v Kent [1997] IRLR 636, the Court of Appeal overturns a refusal by the High Court to grant an interlocutory injunction to enforce a six-month post-termination covenant prohibiting a former employee from soliciting business from those who were his employer's customers during the last six months of his employment and with whom he had dealt at any time during his employment. As the restraint period was only six months and the prohibition was limited to customers within the previous six months, it was not unreasonable in this case for there to be no backward time limit on the employee's dealings with the relevant customers.
