On 28 April 2004, the Court of Appeal decided to refer to the ECJ the question of whether contractual arrangements providing for "rolled-up" holiday pay are compatible with the right to annual leave under the Working Time Directive (WTD)93/104/EC, which is implementedby the Working Time Regulations (WTR).
