The facts
These two cases raised questions as to whether, and under what conditions, Directive 77/187 applies to a situation in which a public body which had contracted-out services decides, on expiry or termination of the contract, to award the contract to a different firm.
Mrs Sánchez Hidalgo was one of five employees employed by Minerva to provide home help services to persons in need, in accordance with a contract with the municipality of Guadalajara in Spain.
