Ministry of Defence v Fair Employment Agency for Northern Ireland [1988] IRLR 151 EAT (0 other reports)

In Ministry of Defence v The Fair Employment Agency for Northern Ireland (14.1.88) EOR19C, Judge Pringle QC in the Belfast Recorder's Court finds that a Roman Catholic was discriminated against on religious grounds in the selection arrangements made for civilian employment on a Navy ship when he was rejected because of a secret reference obtained by Military Headquarters. As the contents of the reference were covered by a national security certificate, the Ministry was unable to rebut the inference that the reference was obtained because of the applicant's religion.
