Sex discrimination: No exemplary damages for breach of Directive

  • expand disabled

Ministry of Defence v Meredith [1995] IRLR 539 EAT (0 other reports)

In Ministry of Defence v Meredith, the EAT holds that exemplary damages are not available to an ex-servicewoman who was dismissed contrary to the Equal Treatment Directive because she was pregnant. Nor was the MoD's attitude towards implementing the Directive at the time of her dismissal relevant to her claim for aggravated damages, because she could not have even suspected that the MoD's conduct or motive was improper.
