A union which is the product of the amalgamation of three other unions has an implied power to discipline its members for conduct which took place prior to the amalgamation, holds the High Court in McVitae and others v Unison [1996] IRLR 33. Any member charged must, however, have been a member of one of the amalgamating unions at the time of the conduct alleged and that conduct must be contrary both to the rules of his or her amalgamating union and to the rules of the amalgamated union.
