The contracting-out of the cleaning work at a local authority college from the council to a private contractor, and a subsequent change in the contractor after a further tendering exercise, were both transfers of an undertaking, holds the EAT in Workman and Birchley v Servisystem Ltd. Therefore, two cleaners who went across to the new contractor on both occasions retained their continuity of employment for the purposes of their later unfair dismissal complaints.
