In Merckx and another v Ford Motor Co Belgium SA 7.3.96 Cases C-171/94 and C-172/94, the European Court of Justice rules that the EC Business Transfers Directive is capable of applying to the transfer of a motor vehicle dealership covering a particular geographical area from one undertaking to another. The Court goes on to confirm the principle that the Directive does not preclude an employee employed by the transferor at the date of the transfer from objecting to being transferred to the transferee.
