In Photostatic Copiers (Southern) Ltd v (1) Mr T Okuda and (2) Japan Office Equipment Ltd (in liquidation), the EAT holds that the automatic continuation of an employee's contract of employment under the Transfer of Undertakings Regulations does not apply unless and until the employee is given notice of the fact of the transfer and the identity of the transferee.
Mr Okuda was employed as a salesman by Photostatic Copiers (Southern) Ltd (PC Ltd) from May 1989.
